Need legal advice. drunk driver smashed car, she should pay for temp rental car, right?
My parents were just recently hit by a drunk driver, they are fine but they can't drive their car, the back-side is smashed in. They had it towed to the repair shop, they won't have thier car for two weeks. Both my parents work really far from where they live. They need a rental car, but I think it's wrong for them to pay for it, I think the drunk who smashed their brand new car should pay. How would they go about getting her to pay for it? Her insurance company should pay for a rental until yours is out of the shop and you should not have to pay for it. Not necessarily. Some insurance companies will cover such things, some won't. And even the ones that cover have restrictions as to amounts and time you can have the rental. And there has to be a demonstrated need also. If the injured party has 3 cars and can drive one of the others while their is being fixed, they won't cover rental.
Bottom line is this, if they really need on they should rent one, and once they get their car back put in a claim for the rental. But it has to be a like car. They can't have their Honda worked on and rent a Cadillac.

Well rental car falls uder your parents car. In the event of an accident thats not your fault, most insurance companies will give you a set amount of money per day to use on a rental. This is usually only if you added this coverage though. I don't think you'll be able to go after the other person for rental car payment unless you take them to court or something and try and get it that way, usually thats what the insurance company deals with, and if they aren't going to help you get your money back, you'll have to pay all the legal fees yourself and go after the driver. Talk to your insurance company about it, see what they say, maybe they can help you get that rental car $$$ back.

But that does NOT mean that the drunk driver is legally bound by this rule. You really have to talk with YOUR own insurance agent.

Sound like your lawyer just going through the motions get yourself another one. Don't be scared to switch lawyers if you aren't satisfied with the one you have. I have a friend that had a bad lawyer, but he switched and got a good one that saved him from going to jail on a fake charge.

I need to consult with you regarding what happened to my friend. My friend is in jail and he was charged with terrorist threat because apparently he threatened his consular (why he had a counselor is related to some thing that has a different story and he was charged with something totally different from what he was charged now.) he was assigned a public defendant and public defendant is going to call some of his friends including me to ask some questions. I am wondering if it will have any influence on my record since I am just an international student studying in US. Also how much is my responsibility regarding the answers I give to the public defendant? Is my name going to be mentioned anywhere associated with him and the crimes he committed?
