I need some legal advice on how to get my daughter back?

My daughter lives with her dad in AZ.. We have 2 daughters together. our oldest lives with me cause he can't deal with her anymore (so he says). He said he wanted to keep our yungest. Plus I have another little one with my bf. last year before I got my oldest back I got to get them for x-mas then I found out my oldest was exposed to adult content. So i did what any worried parent would do and had both of them check out and called the AZ police as well as the IN. police too. When it was time for there dad to take them back I told him he couldn't cause of what happened. He called the IN. police and they said he has rights to take them cause there legally AZ. resedence. We have not been to court on anything not even for custody. I tell him he can't keep her cause he has no right but when the cops let him take them it really confused me. I want to get my daughter back but I don't know what rights I have and don't have.

Plz some one help me!

Desperate momI need some legal advice on how to get my daughter back?
go to court. simple as that. oh ya, stop having babies until you get your life together. those poor kids are being torn apart. they deserve to have stability.I need some legal advice on how to get my daughter back?
I totally do not agree with this answer. I did stop having babies and my life is together. I can say my life is more together then there father's. Plus I am going to court. I just needed more advice on what I can do to get her now without having to wait to go to court.

But that's ok none of these answer's helped. I got all my answer's from real legal ppl and found out since he has no DNA proof that there his. I can go there and get her any time and I am going to do just that.

First thing you need to do is get an atty. If you can't afford one, find the legal aid office in your area. You need to file for custody of both girls. Then you need to get physical custody. If you have not been to court an established custody, then both of you have a shared custody. You can go and get her and the cops cannot make you give her back. If there is no court order he doesn't have a leg to stand on. It would be wisest to at least start court proceedings before getting her. And don't listen to the cops, those bozos usually don't know much about the law anyway. Good luck to you. If you need anymore help feel free to email me.

Wow. If you've not been to court for any actions, then the children belong to you both, and whoever has custody at any moment in time wins. You seriously need legal advice. I suggest you contact the Attorney General in your state and ask what sort of help they can give you. What a mess, dear one. I pray for the best outcome for your children, whomever that may be with.
See a lawyer as they can do what is needed and give the advice that is suitable for your case. Otherwise you may get some advice that will get you in more hot water than you can ever get out of.
You weren't specific what the ';adult content'; was. If was a girlie magazine, R-rated movie, what? You also didn't specify how old this girl is. Can't be too judgemental without more facts
Truth is, you can't get her back. She's as much his as she is yours.

  • I need some legal advice. My boyfriend is from india. I recently found out some disturbing news.?

He apparently has been living and working in the states for 8 years with an expired visa. He says the only way he can stay in the states is if we get married. I and my parents disagree, that the laws have changed and are more strict and harsh since 9/11. I have tried to find the correct law online but cant make head or tails of any of it. Can anyone help and give me the correct answer?I need some legal advice. My boyfriend is from india. I recently found out some disturbing news.?
He's going to have a tough time proving that his intentions are pure in regards to your marriage, when he's already proven that he's willing to break the law in regards to living and working here.I need some legal advice. My boyfriend is from india. I recently found out some disturbing news.?
It's not as simple as just getting married. Because he's here illegally at this point, he should talk with an immigration attorney. There is a lot of red tape that you have to go through. It's expensive. You have to prove that your marriage is not a sham; that you can support him financially if he were to lose his job. And if USCIS decides that you married him just to keep him in the country, he could be deported and banned from re-entering the U.S. Go talk to an immigration lawyer. He needs one.

My husband, who's from Canada, and I went through the process about a year ago. We were able to legally marry and get his green card, but he was in the U.S. legally. That makes a huge difference.
the best way to go with this is to go to a lawyar and ask him about this. ifyou are unable to do this then i guess this was worth nuthen :( good luck and watch it ur parens might be riight on that
i believe if ur a citizen of the US and you marry him, you can file for him.
If his visa is expired, it is illegal to live and work in the US.
He is SOL he has broken our laws If you do marry him he well have to return to his home country and they well consider that when he applies to comes to America

People abandoned things at my house. legal advice?

I helped out this woman and her 4 kids by letting them stay at my home 2 weeks. Then I change my mind about her and payed for her move to a motel for 2 weeks. She left her two beds, a chest for clothes and some boxes and household things. I've being trying to get her to remove her things for the last 8 weeks. She says she will and i continued to set up dates for her to pick up her things. For the last three weekends she never came even tho she said she would. I told her i will give her things to the salvation army. She continues to make threats and wants to sue me if i get rid of her things. for what i know she moved out of state and I have no idea where she lives. all i have is her cell number. my question is what can i do with the stuff she abandoned?People abandoned things at my house. legal advice?
Dump the stuff she can prove nothing!People abandoned things at my house. legal advice?
There are laws the cover abandoned property. Check with your local government office. You may need to post a notice in a local paper or acquire a signed notice that she was notified.....or wait a certain length of time.......
I don't know the law but.......

Try to document all the previous times you asked her to come get her stuff. Call her one LAST time again and ask when she can come get it. If she does not have a date then tell her to figure it out and in 24 hrs. Tell her if she does not call back with a reasonable date she can pick up her crap or she skips out again it's all going to goodwill/salvation army and give her the address of the shop you will take it to. Also Keep paperwork on the motel you paid for.

Personally, I think 8 weeks goes beyond any obligation, you are not storage she is not paying for space so I don't see why you would be legally responsible for her abandoning her property!
    rent a storage unit

    put her stuff in it

    and let her know

after that its up to her she sounds like trouble
Sorry, but I can't answer this one unless you let me know where you live. It is different from jurisdiction to jurisdicition. It could be a short as 30 days and as long as 180 days before you can get rid of her crap.
Send her a certified letter telling her she has 7, 10, or however many days you want to allot her to get her things out.

Ck with your local magistrate also as to how local law reads

concerning this matter. I believe if she does not respond to your C/letter in 30 days you are now the owner of what she left in your home.
check with your local prosecuting attorney i think its yours after 30 days
Contact a lawyer. You may be able to put the stuff in storage and charge her, but although you'd win in small claims court, I doubt you'd ever see a nickle. Depending on local law, you may have to hold it for a period then you can get rid of it.
It is really a situation where each State will have it's legal definitions concerning landlord and tenant rights. If the woman did not have a change of address and did not attain a legal lease agreement then she may or may not fall under the category of ';Tenant'; and her rights to her abandoned property my also become invalid under the State Codes. However, assuming that the woman does have legal rights as a Tenant then you will have to research the laws within your State, County, City, etc.

Here is a site that offers some information which may give you some insight as to the complicity of these situations. Move cautiously as you will not want to lose your advantage over the woman. You need to stay on top of the situation and have the commanding hand.

    Read this: http://www.housingrights.org/renters/pdf鈥?/a>

Also type in the address bar: (housing rights abandoned personal property (your state) and hit enter. That should take you to some other sites that offer similar information.

    Good Luck to You!!

As a former landlord I can definitely say ';Never Again';. Tenants can really give you the screws. Next time you want to help someone out make sure you have a detailed legally binding lease agreement.

I need legal advice regarding a collection agency contract?

I had contracted with a collection agency to try to obtain payment for me on a deliquent account for $1750. About 25 days into the contract, the deliquent account (DA) left a message for me that they would like to work together again and wants to negotiate payment. As specified in the contract, I contacted the collection agency (CA) and let them know. The CA asked what I would like to do, so I said I will work out a number and let the DA know. He said that they could do it for me, but if I want to try, it was okay, knowing that I would still owe them a fee if I collected. The DA had contaced me again a few days later and I tried to negotiate a payment, to no avail. The DA also told me that the CA never contacted them. After that, I sent my required 30 days notice to terminate the CA contract, and planned to take the DA to court. The CA is now sending threatening emails that if I ever collect anything from the DA ever in the future, I still owe them a fee. Can they do that?I need legal advice regarding a collection agency contract?
If the terms of the contract with the CA says they can then yes. You might argue they did not fulfill their end of the bargain but what are you going to do, call the DA that you are suing to testify on YOUR behalf that the CA never contacted him? You are the one that decided to stop the CA from performing, you should have let them do their job or never contracted with them in the first place.I need legal advice regarding a collection agency contract?
    Yes!
Collection agencies are dirty underhanded people who don't care how bad off someone else is, think about your question, are you worried about the guy you sent to the collection agency
If they will take it off your credit report believe it or not it will stay on your credit report for 7 to 10 year if they do not and that with you paying it off
Yes, you signed the debt over to them.
In order to get legal advice you will need to pay an attorney to give it to you. Legal advice is not free. At least not sound advice. Protection costs money.

Can anyone help me PLEASE Legal Advice?

I'm trying to help someone out but have no clue .anyone know where I can go on the internet and find a legal document to fill out and print to take to a court for an emergency child custody hearing? The type of document that you need to take to a judge to schedule a hearing to regain custody of children ??? She spoke to a lawyer and he told her she could do this on her own. and could save almost a grand if she was able to get a copy of this and present it to a judge on her own ... hence saving the money of aquiring a lawyer. Can anyone help me PLEASE Legal Advice?

depends what state you are in for example Michigan has the friend of the court. all you need to do is go to the court house and they do the rest for you. You may want to see if they have a child suport recovery dept. they too will get things going. Oe just go to the court house the ladys there will help you. you have to file.make a court date send a notice . they will help its all done there just tell them you wnat to do it your self
Go to the court where the petition will be heard. They will give you the correct paperwork to fill out, and may also provide free legal advice, if you require. I just finished doing the exact same thing. P.S. Where are you?
    Koolcat is exactly right.
It depends on the jurisdiction. When asking legal questions it really helps to say where you are.

If there really is an emergency, pay the grand and get a lawyer to do it.

The types of emergency in child custody cases can have dire consequences (such as a child being removed from the jurisdiction, never to be seen again)
You can go to the courthouse and they have all the forms you need also that you can fill out on you own.
    http://www.loc.gov/law/guide/index.html

Law guide on line for US. Select your state and begin

    your research.
You don't need to prepare this document in a legal form. Just write a letter and be polite to the judge. The court will honor this letter. Once received, the court will order you to do additional things, like having it notarized, for your document to conform to the legal requirements. However, this ordinary letter can start the proceedings.

Marrying in USA and need legal advice?

    Hello,

I am from Canada and met my boyfriend in USA . I came to USA to get married with him. he told me that the lawyer said I have to be in USA for 3 months and then we can get married . is that true or he is just trying to buy some times for himself ? because If he is just making this up , I don't see any point of staying because obviously he was not sure about his decision when he asked me to join him and move to USA.please help .Marrying in USA and need legal advice?
Im not quite sure. I dont think you have to live in the US for any length of time to get married. I think you just have to make sure you file papers with immigration so that they know you plan to be a US citizen. Dont marry a man you don't know though. And why would you not want to live with him for 3 months before the wedding? Are you marrying a man you dont know? That is never a good idea.
