They'd prefer to help you rather than have you default and cause them grief. If you have utility bills in his name, call up and start new accounts in your name and leave the ones in his name unpaid. Just tell them that he no longer lives there and you'd like to have them switched on in your name instead. Unpaid bills in his name will be his problem, not yours.

As to your situation, you should contact a legal aid attorney since it sounds as though you cannot afford an attorney to handle your situation. You can contact your local court house or county attorney's office for names of legal aid attorneys who can assist you.
As to your husband and his part in this mess. You should as soon as you have an appointment with an attorney give them your husbands address and where the name of his Commanding Officer. The attorney can send a letter to the Command and request assistance in dealing with your husband. He is required under Military Law to support his dependents and is evidently not doing that. When I filed for divorce from my ex-wife, I had to provide support for her and my two children until the divorce and then I provided child support and medical/dental for the children.
You definitely need to contact his command and request assistance from there. You can also contact the nearest Reserve or National Guard Center and talk to their Seargent Major or other Senior Enlisted and see what they suggest for you do to.

Considering all these facts in this case I feel you are still in square no # 1 from where you started, just take this sale agreement document to the person who gave to %26amp; return it after taking your money back from them, if they refuse then ask them to come along with you to India %26amp; get the property transferred in your favor by proper procedure not like they did while sitting in Dubai. Even the power of attorney which they may have given to you may not be acceptable by the Registrar %26amp; he may require the presence of the seller before he register the Sale Deed thereby transfering the title of the property in your favour. Been there and done that, almost. I had to file an emergency temporary custody order for my kids when my ex (we were separated at the time) tried to take my girls and not give them back. I had a lawyer and the financial support of my mom. I would go to the courthouse and ask the circuit clerk for the paperwork to file a motion for emergency temporary custody based on abandonment. Fill out the paperwork, pay a filing fee ($165 in Alabama, different in each state), and get it signed by the judge. For me, this included my lawyer tracking the judge down, explaining the necessity of her signature right that moment, and driving across the county to the restaurant she was having lunch in to get her signature. It's a lot, but it's worth it. That's what my lawyer did for me in a matter of a couple of hours. Have your child's social security number handy. Hope this helps.

Now, they are threatning legal action against me in form of CCJ.
I was wondering if i make them a payment offer of 拢20 p/m. Would this be something they have to accept? I can say that given my finances, this is all i can afford to pay?
Second, i don't understand the 2.5 sick day concept as this firm didn't pay you sick pay and so i don't understand how they can claim that?

you approach to their demand is something acceptable. It is because the firm X cannot ask you to pay the full amount in one off payment. If you say you can pay only 拢20 a month, make a budget to prove that with all your income. (You do not have to reveal all your sources of income. just the main is sufficient)
as you would appreciate, if you are over paid, the firm X can claim that money. However, since it is not your fault, you would not be required to pay full amount at once.
Before you think about court proceedings, write them a letter (by recorded delivery) asking explanation/clarification/breakdown of the money you owe to them. Then you can get a clear picture about the situation. Further, the money you owe them might go down significantly, as at this stage they are doing the second audit. in addition, work out how many holidays you were entitled for that financial/tax year, how many sick pays etc etc and work out how many holidays you had taken at the firm X.
first things first, you write a letter to them asking further clarification/breakdown as soon as possible as mentioned earlier. Send it by recorded delivery to the right person with their reference numbers etc etc.
this letter will be very important just in case go to courts. If you do not communicate with them, it is very likely you are going to be penalized for ignoring their requests and wasting of court鈥檚 time and money.

Recently my car was put into a auto shop to due to the Igintion Cylinder needing to be replaced. Well When the car was taken to the shop the mechanics there couldn't find a problem (my boyfriend and co owner of car was the one handling) Well I late that day had mentioned that the security light was blinking off and on, this was relaid back to the mechanic and they found problem, prior to my boyfriend telling them this they could not find a problem, They did not work on my car at all so they say. Well the auto shop told us that is was going to be $640 for then to put in the part and all the work they did. Also if we did not want them to do anything to the car then we sould have to pay $359 for us to get the car out with no work done, Coming from a family where my father knows about cars and car repair which is the person who would always fixed my car in AZ, we live to FL so he can't fix the car anymore, Anyway he said that if they would have turnned on the car and looked at the gages then they would have known right away, They towed the car there at 10:30am and didn't find the problem until after my boyfriend told them about the security light that turnned on (I thought it was a dummy light because it was blinking off and on for a month) Which the time was around 3:30pm The other thing was that they did not have consent from either myself or my boyfriend but had consent from his mother and grandfather to go ahead and fix the car and the price came down to $540. Before I knew that his family had done this stupid thing, I was calling around for estimates on how much the part was first place I called was the Chevorlet Dealership which the parts department quoted me the part was $187 and change and the service department quoted me $102 dollars for labor and coding the part. What you need are some bona fide ways to say no gracefully.
If the advice requested is not your expertise say so and recommend a different attorney.
If someone drops by unannounced tell them you are sorry, but your next appointment is in a few minutes and you have to prepare. Let them see the secretary if they'd like to make an appointment. You don't have to charge them if you feel they have a worthy cause, but this will prevent them from eating up too much of your time unexpectedly.

A friend of mine works at a japanese restaurant as a server, he's been there approx. 1 1/2 years longer than the current owners have owned the place. A week or so ago my friend was working his shift, and he had two incidents involving a manager
1. The manager became irrate for an unknown reason and was throwing trays around and tossing and splattering trash all over him in the kitchen. This was witnessed by other workers. My friend did nothing, wiped the trash off himself and continued working.
2. Later that same night, my friend was racking glasses in the back, and the manager again became angry, started yelling and came over to him, and jacked him off the floor and started to hit him on his body.
My friend feared for his life because he was battered by his manager, the fact that there was glass, metal, knifes around. The owners did not fire/repremand the manager (btw, the manager has a record of prior workplace incidents like this one)

When you make payments, make sure you always send the payments seperately, and write the account number of the payment to which its to be applied on your check. Also, if you have a coupon book to send when making the payment, make sure you use the correct coupon.

I took my car to a renault garage today bcoz it had a knocking noise and it is still under warrenty till dec 2007. So i left the car at 9am and signed the bit of paper sayin id left it there but ive now got phone call saying the problem was loose wheel nuts and they are charging me 拢25 labour as it took them an hour to find the problem. I refused to pay as i think the warrenty shud cover labour aqnd now they wont give me my car. I got the police involved but as it is civil matter they cant do anything. Would it be wrong legally if i took the car 2nite when garage is closed. Sounds stupid as 拢25 isnt much but this man i spoke to also swore at me and got quite threatening. I left my car as i was upset by the way i was treated. I wont pay the money which some people may think is easier but im skint. Any advice as to what 2 do. I wanna stay right by the law as well so that nothing can come back on me!

First of all, if you have never touched to wheel nuts there is no reason you would check to see if they're tight. If the garage has had the wheel off in the past they might not have torqued them up properly.
The best thing to do is call Renault's customers services (not the garages) and tell them how you've been treated by the garage, and how they were probably the only people to have had the wheel nuts off in the vehicles life. They will call the garage and get it sorted.
I work for a Toyota garage and although it's frustrating spending time looking for a noise when it turns out to be something stupid, it sometimes happens. We would rather let the customer know what we found, but wouldn't charge them as they are more likely to remain a customer.

The garage has a duty of care regarding the safety of you and your vehicle. He should not of swore at you , but there are two sides to every story and we are only hearing the one. To be honest I would pay them and put my tail between my legs and get out of there a.s.a.p. check your wheel nuts on a regular basis and fifty miles after every wheel change.
labor isn't under warranty when the item itself isn't under warranty. tightening loose wheel nuts is not a warranty item, but a maintenance item. oil changes aren't under warranty, so neither is tightening a bolt.
you owe that money, period. to take the car without making payment allows the dealership to now press theft charges on you and the police you called earlier....will now be coming to arrest you and most likely impound your car. causing you more cost.

No it is not a good idea to go to the garage and get your car, as that would be breaking and entering.Although you dont have a legal leg to stand on see if you can get a big mate to go and get your car back....Red tape is a pain in the butt, but the garage do not have to give you your car back unless you pay..Next time get a manual for the car and diy....
Don't go and snatch your car back. Pay them, saying you do so under protest. Then contact Renault's Customer Service people, explaining as you have here and ask for their views in writing.

I'm not sure what '; skint'; means. Probably a slang you dudes use in jolly 'ol england. Anyway, the warranty you spoke of does not cover normal wear and tear items and I'm sure lug nuts or wheel locks are not considered in this warranty. Pay the 25 bucks and get on with your life.
Why would you think a maintenance problem like you not checking the lug nuts would be covered under a warranty? It's not a defect, it's your failure to check. If you were a quart low on oil, would that be covered too? Or your tires low? There are things that are not covered, and that would be one of them.
If you take the car without paying the bill, you can be charged with theft of services. Not car theft as someone is bound to say, because you can't steal what is legally yours to begin with.
Just pay the bill and be done with it, and be glad you caught it before any real damage was done or your tire fell off.

I'm not sure where you are from, and consumer law varies from place to place, but where I'm from a garage must supply an estimate and get approval before doing any work. You may have a Better Business Bureau or equivalent organization to complain to.
I would advise you to pay , retreive your car, and then make a stink. Now matter how you slice it, you would have had to pay to have your car checked and fixed. If you feel that your expense should have been covered by your warranty, take it up with the car manufacturer.
The other thing that I would worry about if I were you is that you're dealing with a bunch of stinkers who might not be above tampering with your vehicule in retaliation for your refusal to pay. You would have a hard time proving they did anything, and could end up with expenses several times what they are now.
Once your car is off their lot you can raise hell without fear of reprisals. Speak with the owner of the garage and explain that you couldn't possible do business with them again after the display of thuggery displayed by his employee.Complain to the car manufacturer and ask why the warranty wasn't honored. Well I have two questions for you, 1. Did they fix the problem or just identify it? 2. What does your warrantee say about diagnosis? Often times diagnosis isn't covered in warrantees, so they may be legally able to charge you for the diagnosis time/labor. On the other hand if they didn't explain to you up front about diagnosis fees, or give you a receipt/contract stating they were doing diagnosis, that is their error. So my opinion is, if they fixed the car and that part is covered under warrantee, I'd try to negotiate getting the diagnosis waived, if they won't do it, I'd pay the diaganosis to get my car back. If they didn't fix the car and they want you to pay for the diagnosis BUT they didn't give you a contract or a copy of the receipt, I would just go pick up my car.
It sounds to me like you are owed a free estimate and informed of such BEFORE they touched the vehicle.
They should have only charged you if you gave the OK to actually work on the vehicle's problem.
I do not recommend taking your vehicle back if they keep it locked somewhere over night. That would be Breaking and Entering into private property. If they keep it parked outside where it could be ';stolen';.. use your keys and take it over night.

Wheelnuts do not come loose if properly tightened, so someone should reimburse you. The offending garage should not have done any chargeable work without your OK, which may have been given unintentionally in conversation. Cars can be held legally if bills are unpaid. So maybe you should pay and sort it out later. Tell Renault atout their attitude though.

Renault dealers normally charge 拢75 per hour. You got off lightly. Its not their fault the wheel nuts were not torqued correctly unless they had recently serviced the vehicle or rotated your tyres / fitted new tyre.

The garage has a duty of care regarding the safety of you and your vehicle. He should not of swore at you , but there are two sides to every story and we are only hearing the one. To be honest I would pay them and put my tail between my legs and get out of there a.s.a.p. check your wheel nuts on a regular basis and fifty miles after every wheel change.
labor isn't under warranty when the item itself isn't under warranty. tightening loose wheel nuts is not a warranty item, but a maintenance item. oil changes aren't under warranty, so neither is tightening a bolt.
you owe that money, period. to take the car without making payment allows the dealership to now press theft charges on you and the police you called earlier....will now be coming to arrest you and most likely impound your car. causing you more cost.
pay the bill......its the right thing to do, the legal thing to do.

It is called '' a mechanics lein''...yes they can hold the car until you have paid for services rendered, an hour is not that long and I think it is $25.00 the amount due? if so...small price to pay.
If you just take the car...it is illegal and you can be jailed for it, theft is the proper term.

No it is not a good idea to go to the garage and get your car, as that would be breaking and entering.Although you dont have a legal leg to stand on see if you can get a big mate to go and get your car back....Red tape is a pain in the butt, but the garage do not have to give you your car back unless you pay..Next time get a manual for the car and diy....
Don't go and snatch your car back. Pay them, saying you do so under protest. Then contact Renault's Customer Service people, explaining as you have here and ask for their views in writing.
Sorry to say , but as a driver it is up to you to make sure your car is safe for the road, IE , Lights, wipers, horn, the wheels and wear of the tyres, This also means wheel nuts,

You are very lucky that you are only paying a basic amount of 拢25, if it is a main dealer garage the hourly rate could be as much as 拢130 per hour.

I'm not sure what '; skint'; means. Probably a slang you dudes use in jolly 'ol england. Anyway, the warranty you spoke of does not cover normal wear and tear items and I'm sure lug nuts or wheel locks are not considered in this warranty. Pay the 25 bucks and get on with your life.
Why would you think a maintenance problem like you not checking the lug nuts would be covered under a warranty? It's not a defect, it's your failure to check. If you were a quart low on oil, would that be covered too? Or your tires low? There are things that are not covered, and that would be one of them.
If you take the car without paying the bill, you can be charged with theft of services. Not car theft as someone is bound to say, because you can't steal what is legally yours to begin with.
Just pay the bill and be done with it, and be glad you caught it before any real damage was done or your tire fell off.
I wouldn't advise you to go get the car in the middle of the night.
I'm not sure where you are from, and consumer law varies from place to place, but where I'm from a garage must supply an estimate and get approval before doing any work. You may have a Better Business Bureau or equivalent organization to complain to.
I would advise you to pay , retreive your car, and then make a stink. Now matter how you slice it, you would have had to pay to have your car checked and fixed. If you feel that your expense should have been covered by your warranty, take it up with the car manufacturer.
The other thing that I would worry about if I were you is that you're dealing with a bunch of stinkers who might not be above tampering with your vehicule in retaliation for your refusal to pay. You would have a hard time proving they did anything, and could end up with expenses several times what they are now.
Once your car is off their lot you can raise hell without fear of reprisals. Speak with the owner of the garage and explain that you couldn't possible do business with them again after the display of thuggery displayed by his employee.Complain to the car manufacturer and ask why the warranty wasn't honored. Find a consumer advocacy organization and complain there.
if your bought the car there you should not have to pay as you are still under warranty but if you decide to pinch it off the premises your braking the law
the thing is the garage can keep your car because you owe them money you can't do anything but pay it they will probably keep putting they cost up as well for having the car on their premises there is nothing you can do as they will make you in to the bad guy there are garages and car dealers out there that rip people off

Well I have two questions for you, 1. Did they fix the problem or just identify it? 2. What does your warrantee say about diagnosis? Often times diagnosis isn't covered in warrantees, so they may be legally able to charge you for the diagnosis time/labor. On the other hand if they didn't explain to you up front about diagnosis fees, or give you a receipt/contract stating they were doing diagnosis, that is their error. So my opinion is, if they fixed the car and that part is covered under warrantee, I'd try to negotiate getting the diagnosis waived, if they won't do it, I'd pay the diaganosis to get my car back. If they didn't fix the car and they want you to pay for the diagnosis BUT they didn't give you a contract or a copy of the receipt, I would just go pick up my car.
It sounds to me like you are owed a free estimate and informed of such BEFORE they touched the vehicle.
They should have only charged you if you gave the OK to actually work on the vehicle's problem.
I do not recommend taking your vehicle back if they keep it locked somewhere over night. That would be Breaking and Entering into private property. If they keep it parked outside where it could be ';stolen';.. use your keys and take it over night.

Wheelnuts do not come loose if properly tightened, so someone should reimburse you. The offending garage should not have done any chargeable work without your OK, which may have been given unintentionally in conversation. Cars can be held legally if bills are unpaid. So maybe you should pay and sort it out later. Tell Renault atout their attitude though.

Renault dealers normally charge 拢75 per hour. You got off lightly. Its not their fault the wheel nuts were not torqued correctly unless they had recently serviced the vehicle or rotated your tyres / fitted new tyre.

So i did what any worried parent would do and had both of them check out and called the AZ police as well as the IN. police too. We have not been to court on anything not even for custody. I tell him he can't keep her cause he has no right but when the cops let him take them it really confused me. I helped out this woman and her 4 kids by letting them stay at my home 2 weeks. Then I change my mind about her and payed for her move to a motel for 2 weeks. She left her two beds, a chest for clothes and some boxes and household things. I've being trying to get her to remove her things for the last 8 weeks. She says she will and i continued to set up dates for her to pick up her things. For the last three weekends she never came even tho she said she would. I told her i will give her things to the salvation army. I need legal advice regarding a collection agency contract?
I had contracted with a collection agency to try to obtain payment for me on a deliquent account for $1750. About 25 days into the contract, the deliquent account (DA) left a message for me that they would like to work together again and wants to negotiate payment. As specified in the contract, I contacted the collection agency (CA) and let them know. The CA asked what I would like to do, so I said I will work out a number and let the DA know. He said that they could do it for me, but if I want to try, it was okay, knowing that I would still owe them a fee if I collected. The DA had contaced me again a few days later and I tried to negotiate a payment, to no avail. The DA also told me that the CA never contacted them. After that, I sent my required 30 days notice to terminate the CA contract, and planned to take the DA to court. The CA is now sending threatening emails that if I ever collect anything from the DA ever in the future, I still owe them a fee. You might argue they did not fulfill their end of the bargain but what are you going to do, call the DA that you are suing to testify on YOUR behalf that the CA never contacted him? depends what state you are in for example Michigan has the friend of the court. all you need to do is go to the court house and they do the rest for you. You may want to see if they have a child suport recovery dept. they too will get things going. depends what state you are in for example Michigan has the friend of the court. all you need to do is go to the court house and they do the rest for you. You may want to see if they have a child suport recovery dept. they too will get things going. Oe just go to the court house the ladys there will help you. you have to file.make a court date send a notice . they will help its all done there just tell them you wnat to do it your self

Marrying in USA and need legal advice?
Hello,
I am from Canada and met my boyfriend in USA . I came to USA to get married with him. he told me that the lawyer said I have to be in USA for 3 months and then we can get married . is that true or he is just trying to buy some times for himself ? because If he is just making this up , I don't see any point of staying because obviously he was not sure about his decision when he asked me to join him and move to USA.please help .Marrying in USA and need legal advice?
Im not quite sure. I dont think you have to live in the US for any length of time to get married. I think you just have to make sure you file papers with immigration so that they know you plan to be a US citizen. Dont marry a man you don't know though. And why would you not want to live with him for 3 months before the wedding? Are you marrying a man you dont know? That is never a good idea.bloom-
