My brother in law was in the begining stages of a custody battle when he passed away unexpectedly. The grandparents of course want to see the kids, but the mom really does not care. They are based in Iowa so it is Iowa law. Do they have any rights. Can we now file for any kind of visitation. We are clueless con someone help. ThanksI need some legal advice for a custody battle?

In the state of Iowa grandparents have all rights to visits with the grandchildren! Yes, you can file right now for visitation rights. By law the mother of the children can not prevent family from seeing the children unless there is good cause which would be like abuse, drug use, unsafe enviroment, and has proof of it. If she doesn't when you go to court it will look bad on her behalf.
