The thing about free legal advice sites is that you get what you pay for. If this is a serious criminal matter, your brother needs to have a lawyer. The Court will appoint one for him if he cant afford it. But under NO circumstances should you rely on any website, or even advice from people here, in a criminal matter. If you participated in the assault then yes you can be charged as well. Probably the only way to get out of it is if the victim says you did not participate or there are other witnesses that will say you did not participate.





You should grow up and learn to walk away from every fight you possibly can. I'd bet money it was over something stupid and now you are going to suffer the time and expense of a legal battle... and possibly some jail time.

How can i get legal advice regarding a pet health insurance company who denied a claim. I appealed to the co.?

i have had the same pet insurance for 8 years. ln feb 2004 my lab had a smal nosebleed. took him to the vet and was told dogs can get nosebleeds and appeared healthy. Had a couple of episodes of reverse sneezing. called the vet and was told most likely allergies. his insurance policy is from july to july. In september he had a large nosebleed and after many tests was diagnosed with nasal cancer. the insurance company refused to pay stating his iinitial symptoms began in the previous policy period and therefore not covered. No where in his medical record does it state he had cancer. I feel as if I've always done the best for my lab, securing lhealth insurance and taking him to the vet for any unusual symptoms and I feel i've been let down by both.


Could the vet have diagnosed him earlier or should the pet health insurance co take responsibilty and pay the medical cost i have incurred for his treatment. Who can i go to for advice. Talk to your vet. He should write a letter to the insurance company and give them a time-line for the cancer diganosis. You should also have the records of your dogs vet exams. You can make copies and send them to the insurance co., highlighting the dates of exams. Have the vet office make you a copy. If they refuse call the Veterinary Medical Board in your state. By law they are required to make you a copy or a written summary of the records. The only other thing is go to an attorney....but that will probably cost you more that the vet bill. It seems it might work to get your vet office to write a short note that the initial symptoms were first discovered in the current policy and sign the note, because they didn't diagnose it as cancer before.





I would read the policy itself because this seems like an awkward argument since you had insurance from the same company in the previous policy as well.





Maybe your vet's office or other dog owners can tell you about a better insurance option that you might consider in the future.
Not sure you have a basis for a legal claim. Don't spend money on a lawyer yet.





The best initial thing you can do is to contact your State's Insurance Commission and request info on what you can do in regards to a dispute about a claim that is being denied by that insurance company. Many times the state commission will have several claim disputes and it sometimes boils down to the invividual adjuster who is being ridiculous in favor of his company or it may be that company's operating policies. Sometimes the state will step in and help out the consumer.

Does your company have a dispute process? (I've heard that term kicked around but thankfully haven't had to use it.) It seems like there *must* be some kind of governing body (like the one previously suggested) that could hold a company accountable. I'm sure that if it's in the fine print of their policies that there may not be recourse, but it's just a shame, and hopefully word-of-mouth could help make it right. I've found some good information on complaints.com and would suggest at the very least that you warn other people about the company.

    Did you file an accident report at work?


    Did you include the fact about missing rails being a hazard?


    Can other people testify there were no rails at that point?





    As long as there are other people who can describe the previous conditions, a photo is not necessary.





    Certainly, you could compel the company to produce documents showing when they had the rails installed. Either their own maintenance crew did it, or they hired a company.





    If the company tried lying about it, all it would take is a couple witnesses telling the truth, and the company will have no credibility.





    Photos are always a good idea, but it's not a ';deal killer';.





    You may not have to take such an adversarial attitude with the company. If you have a scar, they might well recognize that you deserve compensation. Many companies realize that a certain number of legal liabilities are part of the cost of doing business. It might cost them more to fight the case than to settle with you.





    Just remember, the company cannot normally get away with outright lying, as long as you can produce witnesses. Even without witnesses, all you would have to do is prove that the rails were installed after your accident (and maybe in response to your injury). Perhaps they were installed because OSHA forced them to, in order to comply with State or Federal regulations. Remember, everything is documented. There is always a paper trail. They can't ';shred the evidence';.
    Well was your accident recorded in work. If so then that can be used as evidence.





    If the rails were fitted by an external company, then there should be some documentation regarding this somewhere within the workplace. Which should contain date and time of them being fitted.

If that scar can be measured in any way by your state's labor code, then that measurement can be converted to a percentage which will then translate into a dollar amount you are entitled to for this permanent disability.

    As a US citizen who has bought and sold in England, there are no restrictions. Had 2 mortgages as well and even rented one out for a while before selling it. Getting the first mortgage was a bit trying since I didn't have credit established in the UK at the time, but a copy of my US credit report solved that quickly and easily.

By law an employee who works is to be paid on time. There is no excuse and cannot receive a pay check that comes back insufficient funds when employee attempts to cash it. They are causing you to be working for free if you cannot receive a pay check because of their poor budgeting. Is it a legit company?





    The only solution to the employer is that he budgets their money right. They are obviously not. Spending more than what they need to live with in their means. So, they can cut employees down to what they can afford. Or create a budget plan for business expense that does not go over employee pay budget costs. Set aside for two separate business bank accounts. One for employees and one for business expense. This way, both do not risk coinciding with each other causing this problem. This business needs to be put out of their own misery. It's going to haunt them by law suits after law suits. I would not even work here if I found this.

    4 years ago I bought my home. At closing, the company I purchased it from contacted me to tell me not to be suprised as I was going to be asked to sign a 2nd mortgage. I was told ';this is not a real 2nd, but only on paper as the mortgage company will not fund without the 2nd';. This is due to the home being a manufactured home on an acre of land which finance companies do not feel are solid investments as too many people foreclose on them and thus they can only fund 75% of appraised value.





    So, it was done and no, I haven't been aske to pay a dime. Now, I am trying to refinance, and the former company is stating they will not sign off on the 2nd but they will reduce it by $15,000.00 which the mortgage company says No way. The mortgage company has had dealings with this company before and states it is a shady company.





    Now the mortgage company is taking 7 months to close, my ARM is going up to $950 Sept. 1st and I am working my hind end off to make ends meet.Need Legal Advice on a Fradulent 2nd Mortgage?

    You can't leave the state without getting a court order changed. They do this to keep the parents, when seperated, from moving far away and not allowing access to the child to the other parent.

    My wife works in the mental health field. She was hospitalized and missed work for a bit. She returned and her employer said if she worked in a different capacity (half salary position) and for a month without missing any days she would be reinstated back to her old position.     Yes, I certainly would pay a reasonable fee for legal advice of this kind as this would save time searching for the answer myself and would be more convenient than trying to contact a lawyer. If the response suggested I needed to take further action I could then use a lawyer to follow up.

    No, a truly reputable firm would not be involved with a scheme like this.
    I would. In fact I am. I pay 35 a month but they will write letters for me and do a small will for me and they will also look over any paperwork I recieve before I sign to make sure It is safe to sign. They give me all the advise I need and are really helping me with my lawsuit over the phone. I might be settling out of court without a lawyer present because the help they have giving me. I go through pre-paid legal and I recommend them. I have unlimited use with them. The law firm is Parker~Stanbury!!!

    Okay ... you've managed to really confuse me. So, teacher steps out, B accidentally injures A. Teacher does a check to the best of her ability, assesses that serious injury is unlikely, and so does not seek further assistance.





    Father of A shows up, did you say dragging B? As in physically pulling him? B's dad should press charges against A's dad for assualt, to be honest here.





    Teacher intervenes, gets B from A's dad. A's dad gets out of control and ... this is where you start to lose me. The two dads talked with each other (not themselves, I think you mean?) and both are pressing charges against the teacher? What are their charges? A, I can understand, but B?





    The faculty of the school is giving A's dad money to help with ... something. And he's asked for money for medicine (uhhh, a corneal scratch? C'mon, he'd better have receipts). Teacher is being told by A's dad she should pay because A was in her custody when the injury happened.

    That was a confusing story. What I got out of it was that the teacher should have sent the child (A) to the nurse and notified his parents, and never should have identified child B to the parents of child A.     The parents have no legal right to anything. If HE requests a paternity test, the court will grant it. His parents have no standing.





    However, you should NEVER refuse to have paternity legally established. In the first place, your child may NEED to know his true parentage in later life for medical reasons. In the second, even if your long term b/f takes the child as his own, that has zero legal standing later if he decides to renounce the child. At that point, a paternity test can be used to deny his paternity, thus freeing him from any support. The actual father may be long gone and not available to test, leaving you with no support at all.





    If you really want to do it legally, have the correct father listed (either he agrees of a paternity test does it for him), then have the long term adopt the child, making it legally his responsibility. Rebounds parents have no say in the matter.Legal Advice about custody and paternity?

    In most states he can be charged with statutory rape but I'm not sure how it works, a friend of mine had a bf when we were younger that her mom did that to him. But a piece of advice think about when you were that young the more your parents told you not to do something the more you wanted to do it. I would also talk to your daughter and ask her why she likes to go around with him, and then tell her how you feel about it.

    So if your getting $500 per week from your current employer, the one you got hurt at, and than get the job at the new place that pays $750 per week. If your off work due to the work injury your only paid $500 rate and not the higher rate.

    I don't know much about the laws in the states but I am a dispatcher for a police service in Canada and we often field calls for advice.





    Couple of things, unless it states in your court order that the Police may apprehend the child in a case of witholding visitation, they won't. It has to be clearly spelled out what the court expects the Police to do.





    A contempt of court charge should be brought against the Mother by your lawyer or your husband.





    If you want to document these instances, call your local police (All lines are taped usually - note the date and time of your call) ask that an officer call you for advice. This way they still have a record of it but you're not taxing the system by making Officers attend for something they have no control over.     I would ';Strongly'; advise the avoidance of police involvment, as the Judge would more than likely see it as two imature adults who can't conduct themselves as such. It is Important to keep a diary of events and upon request you have documented any necessary violations. If this thing spills over to police involvement, the Judge is more than likely going to have reservations. If she is not in compliance simply file a violation of terms and conditions with the controlling Court and have Her butt hauled back into court and make her comply.     This would be a great ideal if all the legeslative branches (Law Makers) of all the different segments of governments weren't by majority lawyers. Attorneys are in complete control of theirs as well as our destiny. Every new law they put on the books increases their billable hourly rate, their individual power as citizens, their professional power and increases their professions job security.     You apparently feel that you were misled by your ex who used your joint funds for her benefit while telling you that her using the funds was for both your benefits.





    General rule with joint accounts is that either party can withdraw the money, but the money is owned by the party who contributed it. This would give the party who contributed the funds the right to demand the other party return said funds.





    But here you agreed she could use the money. You also apparently had a joint account where you both contributed which makes it difficult to trace whose funds were whose.





    But then again, you sound like you were either the primary contributor or you both were equal contributors and that this was the only thing which was not a joint expense. (Her attorney fees are clearly her responsiblity alone). You may have agreed to let her use the joint money, but you weren't necessarily making her a gift.

    I haven't had employees in Oregon for years so I don't recall the state law on this. But I can't think of a state that allows the employer more than 30 days to pay someone. Given this, you have done all you can do. Don't expect an immediate response from the State. It will take them awhile to look into the situation. The best you can hope as an outcome is that the employer has to ';make you whole'; which means the state implies a calculation to what you would have earned (through investments etc.) or lost (loss of buying power) during the time you didn't have the money. The employer would have to pay you this.





    The employer may also be fined. But you don't see that money the state does.
