I need legal advice. Our former landlord from 3 yrs ago is coming after us.?

We were in an apartment almost 3 years ago. Our lease was up in January and so I wrote our 30 day notice. When we went to go move our things out around the 25th or so, there was an evection notice. Our power had been shut off. I was unable to clean and wasn't even able to get all my things out. I had just had a baby and was having medical complications afterwards to make things worse. Tonight I was served with papers saying that I owe them 1600$. They said it was for a month worth of unpaid rent and cleaning and collection fees. But on the papers there are no court dates. I have a copy of the 30 day notice. The dates on their paperwork and the papers they filed with the courts don't match. What should I do? Need help ASAP please!!!I need legal advice. Yikes... file a counter-suit. Show the check stub you wrote for the last date rent you paid, and a copy of the letter you wrote for your move out date.


Show the dates your power was turned off... and your eviction notice.


It'll be a you-say/they-say. Sounds like just a nasty landlord. Could be he's just counting on you to give in. Show you can be just as confident to fight back and see what happens. But don't panic. Thats what he's hoping for.

I'll be honest..something is wrong with your story.





1st..the power company generally will not cut off power to an apartment without at least calling the individual whose name it's in.





2nd..I can't believe that you came home to an eviction notice, and just continued business as usual, CALLED NOBODY and just took your things and left.





The baby and medical complications don't have anything to do with your case.





It is sounding like this is an after-the-fact story that you ';made up'; for skipping out on the lease and looking for a way to fight the lawsuit.

You've got too many things going on here for a simple answer. Unfortunately, you'll need a lawyer. You may qualify for a free lawyer through your county's legal aid, or, your county or city may have a counseling or resolution group to deal with these types of problems.
