My husband wants to try and get primary custody of his children. The children are ages 13 and 16 and they want to live with their father full time. He is not trying to take them away from their mother and they will be allowed to visit her at any time. The problem is that she will not talk with him about the situation and she knows that her kids do not want to live with her because she had an affair and left and is now involving the man she had an affair with in their lives. They get into arguments over the phone because she hangs up on him when he trys to talk to her about the situation and then cusses him out and gets him very upset. To make matters worse they had an argument over the phone and he said things that he should not have and she had him arrested for telephone harassment. She had recorded the conversation. The kids were with us when he got arrested and now they really do not want to live with her anymore for what all she has done. What would be the best thing to do?I need some legal advice about child custody?
I would suggest retaining an attorney. I know that that can be expensive. Depending on the state your in, the kids are 13 and 16 they can choose the one they want to live with, it really doesn't matter what the parents want. Sorry to say but its true
FORTUNATELY FOR YOUR HUSBAND,THE KIDS ARE OF LEGAL AGE TO CHOOSE WHO THEY WANT TO LIVE WITH. TRY TO KEEP THE ARGUMENTS TO A MINIMUM,BECAUSE SHE WILL USE ANYHTING AGAINST HIM. KEEPING HIS DISTANCE AND SAYING AS LITTLE AS POSSIBLE TO HER WILL MAKE ALL THE DIFFERENCE IN THE WORLD. JUST LET IT GO TO COURT AND THE JUDGE WILL LET THE KIDS DECIDE. I KNOW, I'VE BEEN THERE!
