Hello every body
I need to consult with you regarding what happened to my friend. My friend is in jail and he was charged with terrorist threat because apparently he threatened his consular (why he had a counselor is related to some thing that has a different story and he was charged with something totally different from what he was charged now.) he was assigned a public defendant and public defendant is going to call some of his friends including me to ask some questions. I am wondering if it will have any influence on my record since I am just an international student studying in US. Also how much is my responsibility regarding the answers I give to the public defendant? Is my name going to be mentioned anywhere associated with him and the crimes he committed?
I would like to help him as much as possible but don鈥檛 want to jeopardize my status here.Legal advice needed regarding responsibilities in respect to answers one provide to public defendant?
I assume that they want to question you because you were a witness.
Just say what you saw, and know for first hand; nothing less, nothing more.
If the Court, wants or needs for you to testify, then they will issue a subpoena order.
If you were not part of the alleged incident, you do not have anything to worry about.Legal advice needed regarding responsibilities in respect to answers one provide to public defendant?
You should consult an attorney in the jurisdiction where you are being called to testify.
Every person charged with a crime in the US has a right to a defense, which includes the right to subpoena witnesses who can give testimony in his defense.
If you are subpoenaed to testify in your friend's case, you are obligated to appear and testify truthfully under oath.
If you are not going to be available at trial, you should tell everyone that so that they know to complete your deposition so you don't have to come back from wherever you're a national, to testify.
As far as your name being associated with his crimes, unless you were a party to a crime, at best you're just a witness.
If you were a party to the alleged crime, perhaps you should have your own lawyer.
