It's difficult to prove adultery in court. You have to have pictures of them actually doing it. The court will not just take your word for it, and you can't just show pictures that imply sex -- like a picture of them parked in front of a hotel.
If she is having sex with the guy (and you can prove it beyond the shadow of a doubt), then yes, it's adultery until the judge signs the divorce papers.
