Legal Advice or any advice whatsoever?

This kid hit my sister's car. He would've gotten away with it too if my sister didn't walk out of the house to see him almost drive away. The two exchanged information. However, because the kid's mother hasn't responded to any of the insurance company's information, my sister's car can not be repaired. The family gave my mother and sister a street address where they live, but it was only an address to an apartment complex. The family did not give a suite number. My sister tried calling the driver, but he disconnected his number. This has gone far enough. What kind of legal action can my sister take since the insurance company is not doing anything?Legal Advice or any advice whatsoever?
She can sue the driver and the car owner for the cost of repairs. Whether the owner wants to go through her insurance or not is up to her - it is HER, not her insurer, that owes you.





If she has the license plate but not a valid address she can contact the police for the rest of it. Did she make a police report at the time?

Did your sister have insurance on her car? If she had collision insurance, she can file a claim with her insurance company. They will process the claim for the insurance, and then in turn, will get the money from the kid's insurance company.





If she did not have insurance, or did not have collision insurance, then she will need to file a lawsuit against the kid for the damages done. This could possibly be done in small claims court, depending on the amount of damages that she is claiming. (That amount varies from state to state). She would then name the kid as a defendant. She will also have to figure out the kid's and/or his parents address so that a constable or sheriff can serve him the papers for the lawsuit.





If enough money is involved, she may need to consult an attorney to file the lawsuit for her. The attorney will have resources to trace the address of the kid.





The best bet is to hope that she has collision coverage so that she can have her insurance company pay for the cost.

Hi you could get the police involved. Give them a call (not 999) your local staion. Find out where you stand. Esp if it was intended to be a hit and run if your sister had not walked out to see it.
i suggest that you get a policeman and go to the complex and knock on every door and see who answers or ask where these people live. then, when you get the correct people, the cop will take action from there.





i know this seems archaic and not really efficient, but it's the best thing i thought of considering what you have.
Well this is the time that you try to do a little more investigation go back to the complex and go to the leasing office ask if they can help you locate this family show them the information, if you can't get anywhere with that you can try knocking on each door trying to locate the kids that way. it is a real pain when people try and skip out on responsibilty you can also sit in front of the complex with a camera and wait to see if you see any sign of the kid and when or if you do take a picture of him going into the building, go to dmv and make a report on his licence number they can further assist you in obtaining a record that you can take to your insurance company ....i hoped that helped a little
