In NY state can an injured car passenger sue the vehicle insurer if someone else was driving.?
I insured a car for a friend of mine, they were in an accident and the passenger was injured can they sue me even though i was not even a part of the accident or the driver of the car just had insurance on the car. If you were lending or paying for the insurance without any other connection, while you can be sued, you should be able to get yourself removed from the suit. (Failure to state a claim to which relief can be granted)
Now that means you are not on the title of the car. If you are, then, you could liable for damages from your car. Have a chat with a lawyer, and review you exposure. This is one of those, no good deed goes unpunished.Legal advice needed I insured a car for a friend and now i'm being sued?
Yes, your insurance will be primary and you can be sued for excess. That means if there's money awarded to the injured party your insurance will be responsible up to your limits but they can come after you directly for the rest of it. By insuring the car you've accepted interest in the vehicle and can be held responsible.
I know this isn't when you need to hear this but that wasn't the smartest thing you've ever done. No good deed goes unpunished, right?
If the dollars awarded exceed your insurance limit, you may be at risk. That's why it's unwise to insure some-one else beyond your immediate family. If this happens, you may be able to sue the driver.
What the people are assuming is that if they sue you that they are suing the insurance company.
I have a question for you. Unless that friend is a significant other why would you pay for insurance for a friend?
